Safe Harbor Statement
HawaiiStream™ operates as a content curation and aggregation platform under the safe harbor provisions of the Digital Millennium Copyright Act (DMCA), 17 U.S.C. § 512. We do not host, upload, store, or distribute any video content. All video content displayed on HawaiiStream is embedded directly from YouTube using the official YouTube Data API v3 and YouTube embed player.
How HawaiiStream Works
HawaiiStream curates publicly available YouTube content and organizes it into categories relevant to Hawaii. We provide:
- Links and embeds to publicly available YouTube videos
- Category-based organization of Hawaii-related content
- Proper attribution and credit to all original content creators
- Direct links back to the original YouTube video for every piece of content
Since we do not host any content, the original video files remain on YouTube's servers and are subject to YouTube's own content policies and DMCA procedures.
Fair Use
HawaiiStream's curation service constitutes fair use under 17 U.S.C. § 107 based on the following factors:
- Purpose and character: We provide a transformative curation service that organizes content by Hawaii-specific categories, enhancing discoverability for local creators
- Nature of the work: We display publicly available content that creators have chosen to share on YouTube
- Amount used: We display thumbnails and metadata; the actual video playback occurs through YouTube's official embed player
- Market effect: Our platform drives traffic to creators' YouTube channels, increasing their views and subscriber counts
Submitting a Takedown Request
If you are a content creator and would like your content removed from HawaiiStream's curation, we respect your wishes. Please contact us with the following information:
- Your full legal name and contact information
- Identification of the copyrighted work you claim has been infringed
- The specific URL(s) on HawaiiStream where the content appears
- A statement that you have a good faith belief that the use is not authorized
- A statement, under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorized to act on behalf of the owner
- Your physical or electronic signature
Where to Send Takedown Requests
Send DMCA takedown notices to our designated agent:
Important: Since HawaiiStream does not host video content, if you want the actual video removed from the internet, you must also submit a takedown request directly to YouTube through their Copyright Complaint Process.
Our Response
Upon receiving a valid DMCA takedown notice, we will:
- Promptly remove or disable access to the referenced content on our platform
- Notify the content creator (if applicable) of the takedown
- Process counter-notifications in accordance with DMCA procedures
We aim to respond to all valid takedown requests within 48 hours.
Counter-Notification
If you believe your content was removed in error, you may submit a counter-notification containing:
- Your full legal name, address, and contact information
- Identification of the material that was removed
- A statement under penalty of perjury that you have a good faith belief the material was removed by mistake
- Consent to the jurisdiction of the federal court in your district
- Your physical or electronic signature
Repeat Infringers
In accordance with the DMCA, HawaiiStream will terminate access for users or channels that are repeat infringers in appropriate circumstances.
